Terms & Conditions
Welcome to Pivot (“we,” “us,” or “our”). These Terms and Conditions (“Terms”) govern your access to and use of our coaching services, memberships, digital resources, events, and related offerings (collectively, the “Services”). By purchasing, registering for, or using any of our Services, you agree to be bound by these Terms. Please read them carefully.
1. Services Provided
We provide coaching, group programs, resources, and events intended for personal development, wellness, and education. Our Services are not a substitute for medical, psychological, or therapeutic treatment. We do not diagnose, treat, or prescribe. You should consult a licensed professional for any medical, psychological, or psychiatric concerns.
2. Memberships & Pricing
Membership options are set out on our website and may include different levels of access to coaching, resources, and community events.
All prices are listed in New Zealand dollars (NZD) unless otherwise stated.
Pricing and inclusions may change; however, any change will be communicated in advance.
Ongoing memberships are billed on a recurring basis (weekly or monthly, depending on plan).
All memberships are subject to a minimum 4-week lock-in period.
3. Payment Terms
Payments must be made in full and in advance via the payment methods available on our website.
By purchasing a membership or service, you authorise us to automatically charge your payment method at the agreed interval until you cancel in accordance with these Terms.
4. Cancellations & Refunds
Memberships cannot be cancelled during the initial 4-week lock-in period.
After the lock-in period, you may cancel your membership at any time by providing at least 2 weeks’ written notice before your next billing date.
Cancellations with less than 2 weeks’ notice may result in one final billing cycle being charged.
No refunds are given for partially used billing periods, missed sessions, or unused resources.
We do not offer free trials unless explicitly stated on the website or in writing.
5. Session Rescheduling & Attendance
If you cannot attend a booked 1:1 session, you must provide at least 24 hours’ notice to reschedule. Sessions cancelled or missed with less than 24 hours’ notice will be forfeited.
Group coaching sessions, live events, or workshops are non-transferable and cannot be rescheduled.
6. Eligibility
Services are available to individuals aged 18 years and over.
Minors (under 18) may participate only with written consent from a parent or legal guardian.
7. Code of Conduct
By participating, you agree to:
Treat coaches, facilitators, and other participants with respect.
Refrain from harmful, offensive, or disruptive behaviour.
Maintain confidentiality regarding other members’ personal information.
We reserve the right to suspend or terminate access without refund if these standards are breached.
8. Intellectual Property
All resources, materials, guides, and digital content provided by us remain our intellectual property.
You are granted a limited, non-exclusive, non-transferable licence for personal use only.
You may not copy, distribute, modify, or resell any materials without prior written permission.
9. Limitation of Liability
To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, or consequential damages arising from the use of our Services.
You acknowledge that results may vary and are not guaranteed. Your success depends on your own commitment and actions.
10. Indemnity
You agree to indemnify and hold harmless Pivot, its owners, contractors, and affiliates from any claims, damages, liabilities, or expenses arising from your use of the Services or your breach of these Terms.
11. Governing Law
These Terms are governed by the laws of New Zealand, and any disputes shall be resolved in the courts of New Zealand.
12. Amendments
We reserve the right to update these Terms from time to time. The most current version will be available on our website. Continued use of the Services after changes indicates acceptance of the updated Terms.
